TERMS OF SALE

When booking a spa treatment or service, you the customer are entering into a contract for use of our services at Indigo Eco|Spa. This agreement has certain terms and contractual stipulations which are conditional to our acceptance of your spa reservation(s). These terms our outlined herein. By utilizing our site(s), navigating the web pages herein, making a reservation for any service or ordering any product you expressly agree to be bound by these terms and conditions stated here.

Spa Service Cancellations

In most cases, when you book a treatment, service or feature with Indigo Eco|Spa (Stevenswood Spa Resort), considerable efforts are being made to accommodate your requests; including but not limited to scheduling of staff, preparation of facilities and restriction from other client’s requests for services. Due to the nature of the spa business and the inherent costs associated with allocating these and other needed resources, Indigo Eco|Spa regrets that cancellations can not be accepted for reservations except in the following circumstances. 1) When a service or treatment is booked for a period more than 30 days in advance AND 2) Such reservation is cancelled within 72 hours of the original booking being made AND 3) Such reservation was for a party of less than 3 persons, AND 4) Such reservation was for less than 3 treatments. Therefore, service cancellations for treatments occurring in less than 30 days to the future are not eligible for refunds. A service fee equal to amount of the treatment or service reserved shall apply.

Client Age Policy

Indigo Eco|Spa is dedicated to providing excellent customer service in our spa environment. In order to achieve this, guests must be 18 years of age. Guests who are 16 and 17 are eligible to receive certain facial treatments and nail care, only when accompanied by their parent or legal guardian at least 25 years of age, and excludes spa use.

Product Guarantees

This policy limits your rights as a consumer. Certain jurisdictions may restrict or forbid these or other limitations. Contact your legal professional if you are in doubt concerning your legal rights. Indigo Eco|Spa strives to provide quality spa products and services. All our products are guaranteed by the individual manufacturers. See product inserts or packaging for specific details. Indigo Eco|Spa makes no additional claims, warranty or guarantee with regards to any product or service. Individual manufactures are responsible for their own warranties and should be contacted directly concerning product guarantees. Indigo Eco|Spa makes no claims as to a product or service being suitable for a certain use. Indigo Eco|Spa is NOT a licensed medical facility or practice and makes NO CLAIMS whatsoever regarding any medical benefit from the use of any of it’s products, services or treatments. Any statements made by Indigo Eco|Spa, and any of it’s employees, agents, subcontractors or service providers have not been evaluated by any government agency with regard to their accuracy, including but not limited to the Food and Drug Administration. None of Indigo Eco|Spa’s products, services or treatments are intended to diagnose, treat, cure or prevent any disease or medical condition.

Medical Care

Indigo Eco|Spa is not a medical facility and in no way practices any medically related services. Any advise, recommendations or product suggestions are for retail sales purposes only. Customer understands that they take full responsibility for their own decisions and that Indigo Eco|Spa strongly recommends the consultation with a licensed medical practitioner before beginning any weight loss, skin treatment or body shaping programs.

Health Information

Indigo Eco|Spa does not warrant or guarantee the accuracy, completeness, correctness, timeliness, or usefulness of any medical or health information furnished to customer, stated in any literature, posted or otherwise available on or through access to this or any other Site. ALL information provided by Indigo Eco|Spa are for educational purposes only and in summary form intended to provide general consumer understanding and knowledge of spa related care topics and Indigo Eco|Spa is not responsible and shall not be liable to you or anyone else for any action or decision taken in reliance upon the information furnished to you by any of Indigo Eco|Spa employees, agents, contractors or representatives, nor any information contained in this Site. You are responsible to review and understand all package and package insert information concerning products purchased from Indigo Eco|Spa.

YOU SHOULD NOT USE THE INFORMATION GIVEN BY INDIGO ECO|SPA PROFESSIONALS OR DATA CONTAINED ON THIS SITE FOR DIAGNOSING, TREATING, CURING OR PREVENTING A HEALTH PROBLEM OR PRESCRIBING A MEDICATION. YOU SHOULD CAREFULLY READ ALL INFORMATION PROVIDED BY THE MANUFACTURERS OF THE PRODUCT ON OR IN THE PRODUCT PACKAGING AND LABELS BEFORE USING ANY THE PRODUCT. Allergies

If you are allergic to anything you must notify Indigo Eco|Spa before booking any service. All services are performed with products that have known allergens for certain persons with allergic reactions such as latex, products made with nuts, apricots, grape seed extract, iodine and other common allergens. If you are allergic to anything, there could be serious complications when receiving  a treatment or service at Indigo Eco|Spa. As such, Indigo Eco|Spa can not be held liable for any reactions, allergic or otherwise and cautions guests who have allergies to consult with a medical professional before using any product or ordering any spa service. Indigo Eco|Spa strives to use hypo-allergenic products but does not warrant any of it’s products or services to be free of any allergens whatsoever. Caution is strongly advised for anyone who has known allergies.

Ingredients Product Use Limitations

Indigo Eco|Spa Spa Essentials will not be held responsible for injuries due to the use or misuse of any of our private label or retail products. We make every reasonable attempt to list all ingredients used in our private label products and spa services. However, due to manufacturing conditions, 3^rd party formularies and circumstances beyond our control, we make no warranty or guarantee with regard to disclosure of ingredients in any products used or sold in Indigo Eco|Spa.

Those with sensitivities or allergies to any of the ingredients listed should not use that product.  If a rash, sensitivity or allergy develops from using any of our services or products, discontinue use immediately and contact your health care professional.  Always perform a "patch test" on any bath, cosmetic, or skin care product before use.  To perform a patch test, apply a small amount of product to a small area on the skin (inside arm works well), and cover with a first aid bandage for at least 24 hours.  If there is visible irritation or pain, do NOT use the product.  This test should always be performed, especially if you have a known skin allergy or fragrance sensitivity. Some of our products may contain nut butters or oils (for example, Shea butter).  Persons with nut allergies should avoid any such products.  Please feel free to contact us if you have any questions.

All of our products should be kept out of children's reach, even those deemed appropriate for use by children.  You should avoid getting any of our products in or near your eyes.  Even our eye treatments should be used with care. 

Our products should not be used for anything other than the purpose for which they were created. Indigo Eco|Spa (or any agent thereof) will not be held liable for misuse, allergic reactions or any injury suffered from the known or unknown and consenting use of our products.  When you place an order or book a spa reservation with Indigo Eco|Spa you acknowledge this policy and release us from liability if such a situation should arise.

Indigo Eco|Spa makes absolutely no medical claims for any of our products. The contents of this website and advise, dispensing, application or recommendation of any product, supplement or nutritional are for informational purposes only, and should never be substituted for professional medical advice, diagnosis, or treatment.  You should always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. 

Expectant Mothers – Medial Considerations

Many of our products contain pure essential oils that are not considered pregnancy-safe, and some that may exacerbate chronic conditions.  If you are pregnant, lactating, or have any other health conditions such as epilepsy, diabetes, etc, please consult your physician before using our products or booking a spa service, and advise us of the condition prior to booking your appointment.

Limitation of Liability

Indigo Eco|Spa at Stevenswood Spa Resort (part of Stevenswood Hospitality Group, LLC)  shall not be liable for any special or consequential damages that result from the use of, or the inability to use, the materials on this site or the performance of the products or services offered, even if Indigo Eco|Spa has been advised of the possibility of such damages. Applicable law may not allow the limitation of exclusion of liability or incidental or consequential damages, so the above limitation or exclusion may not apply to you.

Typographical Errors

In the event that a Indigo Eco|Spa product is mistakenly listed at an incorrect price, Indigo Eco|Spa reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Indigo Eco|Spa reserves the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Indigo Eco|Spa shall issue a credit to your credit card account in the amount of the incorrect price.

Term; Termination

These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Indigo Eco|Spa without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Notice

Indigo Eco|Spa may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable method to the address you have provided to Indigo Eco|Spa.

Miscellaneous

Your use of this site shall be governed in all respects by the laws of the state of California, U.S.A., without regard to choice of law provisions, and not by the 1980 U.N. Convention on contracts for the international sale of goods. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Indigo Eco|Spa products) shall be in the state or federal courts located in Northern California. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Indigo Eco|Spa products) must be commenced within thirty (30) days after the claim or cause of action arises. Indigo Eco|Spa's failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any of these terms and conditions. Indigo Eco|Spa may assign its rights and duties under this Agreement to any party at any time without notice to you.

Use of Site

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language, is strictly forbidden. Impersonation of others, including an Indigo Eco|Spa or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited. You may not upload to, distribute, or otherwise publish through the site any content which is libelous, defamatory, obscene, threatening, invasive of privacy or publicity rights, abusive, illegal, or otherwise objectionable which may constitute or encourage a criminal offense, violate the rights of any party or which may otherwise give rise to liability or violate any law. You may not upload commercial content on the site or use the site to solicit others to join or become members of any other commercial online service or other organization.

Participation Disclaimer

Indigo Eco|Spa does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Indigo Eco|Spa is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Indigo Eco|Spa reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to Indigo Eco|Spa in its sole discretion.

Indemnification

You agree to indemnify, defend, and hold harmless Indigo Eco|Spa, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Third-Party Links

In an attempt to provide increased value to our visitors, Indigo Eco|Spa may link to sites operated by third parties. However, even if the third party is affiliated with Indigo Eco|Spa, Indigo Eco|Spa has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Indigo Eco|Spa. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Indigo Eco|Spa seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).

Gift Certificates

Gift cards and gift certificates may be presented as payment for merchandise or services at Stevenswood Spa Resort. Gift cards will not be replaced if lost or stolen unless you have registered it at 1-800-421-2810. Spa packages require a minimum 48 hour cancellation notice or a cancellation fee equal to the service fee for the scheduled treatment will apply. Gift cards are not a debit/credit card, have no implied warrantees and cannot be redeemed for cash or gratuities. After 12 months of non-use of a gift card, a $50 per year dormancy fee will be deducted from its balance until its balance is $0 or this card is used again, except where prohibited by law. Exclusions may apply.

Product and Service Availability

Indigo Eco|Spa controls and operates the site from its headquarters in California in the United States of America. We in no way imply that the materials on our site are appropriate or available for use outside of the United States and we will not be able to fill your order if you require shipping outside of the United States.

We cannot guarantee that a product listed as "In stock" will actually ship right away, as inventory can change significantly from day to day. In rare cases, a product may be in stock when you place your order, and sold out by the time your order is processed. However, if an item that is marked "In stock" in your shopping cart when you place your order is sold out at the time your order is processed, we will notify you by email that your order will not be filled and your credit card will refunded if charged.

Colors

We try to display the colors and layouts of our products, facilities, and spa as accurately as possible. Nevertheless, as the actual colors, perspective, scale and shading you see will depend on your monitor, internet settings, photography treatments and more; we cannot guarantee that your monitor's display of any color will be accurate.

Backorders (out of stock)

Backordered merchandise includes items that are not currently in stock. In most cases, these items are on order from our manufacturing facilities or suppliers. In some cases, we are researching or waiting for stock information from one or more of our suppliers.

Indigo Eco|Spa will make every effort to get the item(s) back in stock as soon as possible. If we haven't been able to locate and ship the item(s) to you in 30 days, an order status email will be sent to you. If for any reason we determine that a backordered item is no longer available, we will cancel the item from your order and notify you via email.

Retail Merchandise Returns

We guarantee your satisfaction with all Indigo Eco|Spa merchandise. However, due to the fact that the majority of our products are applied to the body and are of a chemical nature, most  product items are not eligible to be returned. Only upon authorization for returned merchandise can then eligible returnable products be shipped back to us via US Mail, UPS, or other traceable carrier with your receipt and order number/confirmation, for a merchandise exchange or credit.  Refund of the purchase price (minus shipping and handling charges) are allowed only in special circumstances, with prior authorization. If you receive a damaged or defective item, we will promptly send you a replacement after you have returned the damaged or defective product, with your explanation. You will not be charged any additional shipping or handling fees for replacement of such damaged or defective shipments. We do not give refunds or exchange samples, gifts with purchase items, gift certificates, promotional items, discounted purchases, package sales or gift card offerings. When returning any retail merchandise to us be sure to package said merchandise carefully and professionally, in such a manner as to protect it during transport. We can not be held responsible for merchandise damaged in transit. Also, be certain to ship via a reputable carrier, using a traceable insured means.

Product Orders

PRICES AND AVAILABILITY OF THE PRODUCTS AND SERVICES LISTED ON THE SITE ARE SUBJECT TO CHANGE WITHOUT NOTICE. The listing, description of, or reference to, a product or service on the site does not imply that the product or service is presently available or that we endorse that product or service. In the event a product or service is listed at an incorrect price due to a typographical error, error in pricing information received from a supplier, or any other reason, we shall have the right to refuse or cancel any order placed for such product or service at the incorrect price, even if the order has been confirmed and/or your credit card has been charged. If your credit card has already been charged for the purchase and your order is cancelled by us, we shall promptly issue a credit to your credit card account in the amount of the incorrect price.

Retail Merchandise Order Acceptance

Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason or for no reason at all. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any product or service.

Shipping Conditions and Printer Errors

In compliance with FAA regulations, we are unable to ship products containing alcohol via the US Postal Service. We are unable to accept orders for P.O. Box addresses. We are not responsible for errors due to printing or web site errors.

Product and Service Availability

Prepackaged gifts are assembled individually and may vary slightly. Indigo Eco|Spa reserves the right to substitute a product of equal value and nature if the original product becomes unavailable.

Payment

You are responsible for any payments due for any products or services ordered through your account. If we do not receive payment from your credit issuer or its agents, you agree to pay all amounts due to us, plus interest at a rate of 24% per annum, in addition to any legal fees. You shall also be responsible for any costs of collection of overdue payment.

Sales Tax

We are required by law to charge applicable sales tax on products shipped to those jurisdictions that charge such a tax and in which we operate.

Ownership of Materials on the site

Stevenswood Hospitality Group, LLC is, unless otherwise stated, the owner of all copyright, trademark, patent, database and other proprietary rights in the site and its contents. Without limitation of the foregoing, we own a copyright in the site as a collective work and/or compilation, and in the selection, coordination and arrangement of the information and content in the site. You may not publish, distribute, extract, re-utilize, or reproduce any part of the site in any material form (including photocopying or storing it in any medium by electronic means) other than in accordance with the limited use license set out in our copyright notice or as permitted by the United States Copyright Act. Except as expressly provided in these Terms of Use and the copyright notice, we grant no rights to you under any patents, copyrights, trademarks, trade secrets or any other proprietary rights.

You may not without the prior written permission of Indigo Eco|Spa use any computer code, data mining software, "robot", "bot", "spider", "scraper" or other automatic device, or program, algorithm or methodology having similar processes or functionality, or any manual process, to monitor or copy any of the web pages, data or content found on this site or accessed through this site. You also may not: engage in the mass downloading of files from this site; use the computer processing power of this site for purposes other than those permitted above; or flood this site with electronic traffic designed to slow or stop its operation.

User Comments, Feedback and Other Submissions

We do not solicit nor do we wish to receive any confidential, secret or proprietary information or other material from you either through the site, any of its services, by e-mail, or in any other way. Registration and Security

If you wish to purchase any products or use certain services on the site, you must open an account with us and provide the required information to us.
